1. Scope of application

These General Terms and Conditions (GTC) apply to all services offered via the website SycheckSystems.com (hereinafter “Website”).

2. Contractual partner

The operator of the Website and contractual partner is Sycheck Systems (hereinafter “Provider”).

3. Offer and conclusion of contract

3.1 The presentation of the services on the Website does not constitute a legally binding offer, but an invitation to enquire. Errors excepted.

3.2 By sending an inquiry using the corresponding form on the Website, the Customer submits a non-binding inquiry for the provision of the services specified therein. The provider then prepares an individual offer and sends it to the customer by e-mail.

3.3 The contract shall only come into effect when the Customer accepts the Provider's offer in writing or in text form (by e-mail).

4. Prices and terms of payment

4.1 The prices for the services shall be calculated individually on the basis of the Customer's request and listed in the offer.

4.2 Payment shall be made after the service has been provided and the invoice has been issued, unless otherwise agreed in the offer. Payment is due immediately and without deduction.

4.3 Accepted payment methods are bank transfer, credit card, PayPal or other payment methods specified in the offer.

5. Terms of service

5.1 The services shall be provided on site at the customer's premises, unless otherwise agreed in the offer.

5.2 The exact time and place of the service shall be determined as part of the offer and subsequent acceptance by the Customer.

6. Right of withdrawal

6.1 Consumers have a fourteen-day right of withdrawal.

6.2 The right of withdrawal shall not apply to services that have already been provided in full or if the performance of the service has commenced with the express consent of the customer before the expiry of the withdrawal period and the customer has taken note of this.

7 Cancellation and rebooking

7.1 Cancellation of the service is possible free of charge up to 14 days before the agreed date. After this date, the following cancellation fees shall apply:

• 50% of the agreed price if canceled up to 7 days before the date
• 100% of the agreed price if canceled less than 7 days before the date

7.2 Rebookings are possible subject to agreement and availability. The Provider shall endeavor to accommodate the Customer's wishes.

8. Liability

8.1 The Provider shall be liable without limitation for intent and gross negligence.

8.2 The Provider shall only be liable for simple negligence in the event of a breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the Customer may regularly rely. In this case, liability is limited to the foreseeable, typically occurring damage.

8.3 The above limitations of liability shall not apply in the event of injury to life, limb or health.

9. Data protection

10. Final provisions

10.1 Contracts between the Provider and the Customer shall be governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Provider shall be the registered office of the Provider.

10.3 Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
